Introduction and Definitions

  • These terms and conditions govern all sales and transactions between makan.shop hereinafter referred to as the "Seller", and the purchaser of goods "Buyer"
  • "Goods" refer to the products offered by the Seller.
  • "Services" refer to any additional services provided by the Seller, such as customization or installation.
  • "Website" refers to the e-commerce platform “makan.shop “operated by the Seller.

 

Scope of Agreement

  • By placing an order through the Website or otherwise engaging in a Transaction with the Seller, the Buyer agrees to be bound by these Terms.
  • The Company may vary these conditions by agreement in writing with the Customer.



Orders and Payments

  • Orders for Goods may be placed through the Website or by contacting the Seller directly.
  •  Pricing for Goods is as listed on the Website or as agreed upon between the parties in writing.
  • Payment for Goods is due in accordance with the payment terms agreed upon between the parties.
  • Any Goods returned or to be returned by the Customer under our Returns terms and conditions policies does not alter the payment terms on an invoice.
  • All prices listed is in Saudi Riyal
  • Prices provided in quotations are subject to change and remain valid for the duration specified in the quotation.
  • Prices listed on the Company's website are subject to change without prior notice. While we strive to ensure accuracy, discrepancies may occur, and the Company reserves the right to correct any pricing errors or inaccuracies as necessary.

 

Product Description and Specifications

  • The Seller provides detailed descriptions of the Goods, including materials, dimensions, colors, and any other relevant specifications.
  • The Buyer acknowledges that slight variations in color, texture, or dimensions may occur due to the nature of manufacturing processes or materials used.

 

Shipping and Delivery

  • The Seller offers shipping of Goods via container shipping to the Buyer's designated location for pre-orders, and alternatively, for stock items, the Seller provides delivery via local courier services to the Buyer's specified address.
  • Estimated delivery timescales are provided by the Seller and are subject to change based on factors beyond the Seller's control.
  • The company will not dispatch Goods to addresses outside Saudi Arabia.
  • Shipping and assembly costs will be itemized and provided separately with each checkout or quotation. 




Returns and Refunds

 

Eligibility and Time Frame:

  • Products should remain in their original state and packaging, as delivered (either as parts or fully assembled) and should not have been personally used.
  • Returns/Exchange request must be initiated within 48 hours of receiving the order.
  • A return is only permissible in cases of damage, missing components, or discrepancies in specifications.
  • The Company reserves the right to inspect Goods to be returned.
  • Items pre-ordered ( manufactured upon client request) or customized according to individual preferences are not eligible for returns or exchanges

 

Process:

  • An original packing slip/invoice is required to initiate a return or exchange.
  • Submit your return/exchange request through our Customer Service team at wecare@makan.shop to initiate the process.
  • Upon confirmation of the return/exchange, a designated courier will contact you to facilitate the pickup of the package.

Refunds and Credits:

  • Refunds are exclusively processed via bank transfer and are expected to be completed within a period of 7 to 14 working days. 
  • Full refunds will be processed after the return/exchange process is completed and the returned order is received at our warehouses.
  • The Company’s liability is limited to either:
    • (i) Replacing the faulty Goods
    • (ii) Refund the payment of the fulty good 

 


Warranties, Limitations of Liability, and Exclusions

  • The Seller warrants that the Goods are free from defects in materials and workmanship for a duration determined by the manufacturer, commencing from the date of delivery, provided that the product was used under normal conditions and for its intended purposes as designed.
  • In the event of a valid warranty claim, the Seller's liability for any damages arising from the use of the Goods is limited to the purchase price paid by the Buyer.
  • The Seller disclaims liability for consequential damages, indirect damages, or lost profits.
  • The warranty coverage excludes product defects caused by the following:
  1. a) Mechanical damage occurring after the goods were released to the Customer.
  2. b) Damages during transport (applicable in case of personal collection of the goods by the Customer).
  3. c) Improper assembly (relevant in case of delivery without the assembly service).
  4. d) Changes made by the Customer.
  5. e) Natural wear of product components.
  6. f) Actions contrary to the intended use of the product.
  7. g) Force majeure events beyond the control of the Seller.



Intellectual Property

  • The Seller retains all intellectual property rights associated with the Goods, including trademarks, copyrights, and patents.
  •  The Buyer agrees not to reproduce, distribute, or use the Seller's intellectual property without prior written consent.

 

 Confidentiality

  • Both parties agree to maintain the confidentiality of any proprietary information shared during the course of business.
  • Confidential information may only be disclosed to authorized representatives of the parties and used solely for the purpose of fulfilling the Transaction.

 

Governing Law and Dispute Resolution

  • These Terms are governed by the laws of the Kingdom of Saudi Arabia.
  • Any dispute arising out of or in connection with these Terms shall be resolved through arbitration in Dammam city, Saudi Arabia, in accordance with the rules of Saudi Arabia.
  • The buyer shall be liable for all costs incurred by the seller in recovering outstanding monies from the Customer, including collection agency fees, court costs and bank dishonor fees.
  •  

    Force Majeure

    • Neither party shall be liable for any failure or delay in performance under these Terms to the extent caused by force majeure events beyond their reasonable control.
    • The affected party shall promptly notify the other party of the force majeure event and take reasonable measures to mitigate its effects.

     

    Privacy Policy

    • The Seller collects and uses personal information from the Buyer in accordance with its Privacy Policy, available on the Website.
    • The Buyer acknowledges and agrees to the terms of the Seller's Privacy Policy.

     

    Supplier Relationships

    • The Buyer acknowledges that the Seller may source products from various suppliers, including overseas factories.
    • These Terms apply to all Transactions conducted through the Website or otherwise between the parties, regardless of the original source of the Goods.

     

    Miscellaneous

    • These Terms constitute the entire agreement between the parties and supersede any prior agreements or understandings, whether written or oral, relating to the subject matter herein.
    • If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
    • The Seller may modify these Terms at any time by providing notice to the Buyer. The Buyer's continued use of the Website or engagement in Transactions following such notice constitutes acceptance of the modified Terms.
    • These Terms may be executed electronically and in counterparts, each of which shall be deemed an original and all of which together shall constitute one and the same instrument.

     

    Pricing Structure and Additional Fees

    • Additional fees such as shipping, handling, taxes, and other charges may apply depending on the nature of the Transaction.
    • The specific details of pricing structure and additional fees will be elaborated upon in the offer provided by the Seller, including any negotiated terms or discounts applicable to the Buyer's order.



    Product Inspection and Acceptance

    • Upon receipt of the delivered products, the Buyer is required to conduct a thorough inspection to ensure conformity with the order and to identify any discrepancies or defects.
    • The Buyer must report any discrepancies or defects in the delivered products to the Seller within 2 days of receipt.
    • Failure to report discrepancies or defects within the specified timeframe may result in the Buyer forfeiting their right to remedy or replacement, as determined by the Seller.

     

    Anti-Bribery and Corruption

    • The Seller affirms its commitment to ethical business practices and expressly states that it does not engage in any form of bribery or corruption in its business operations.
    • The Buyer is required to comply with all anti-bribery laws and regulations applicable in the jurisdiction(s) where it operates.
    • Any indication or suspicion of bribery or corrupt activities should be promptly reported for investigation and appropriate action.

     

    Health and Safety Assurance

    • The Seller warrants that all products sold comply with relevant health and safety regulations applicable in the jurisdiction(s) where they are marketed or sold.
    • The Buyer acknowledges that proper installation and use of the products are essential for ensuring safety. Therefore, the Seller disclaims liability for any injuries or damages resulting from misuse, improper installation, or failure to follow recommended safety guidelines provided with the products.

     

    Presentation and Photography Rights:

    • The Company reserves the right to present projects and showcase its work, including the use of project descriptions and company logos, on its official website.
    • The Company has the right to photograph and/or record video footage of projects completed for clients.
    • These photographs and videos may be shared on the Company's website and official social media channels for promotional purposes, unless explicitly requested otherwise by the client.



    Storage Fees for Delivery Delays

    • you agree that in the event of a delivery delay caused by the customer, which exceeds the agreed-upon delivery date as per the agreement, an additional storage fee will be charged.
    • The storage fee rates are as follows:

    For a 40ft Full container load, the rate is 360 SR per day.

    For a 40ft Half container load, the rate is 180 SR per day.

    • These storage fees will be applied from the date of the originally agreed-upon delivery date until the date of actual delivery or collection by the buyer.



    Cancelation Policy:

    • Orders for Goods cannot be suspended or canceled. The Customer shall pay all reasonable expenses incurred by the Company due to suspension or cancellation.
    • For unexpected circumstances, the Customer shall bear all reasonable expenses incurred by the Company due to suspension or cancellation.
